1. INTRODUCTION

By accessing or using the Hide Services, you agree to this Terms of Use Agreement ("Terms" or "Agreement"), including our Privacy Policy and Cookie Policy, so it is important that you read this Agreement and these policies and procedures carefully before creating an account.

These Terms will be updated from time to time, so please check this page regularly for updates.

These Terms of Use constitute an agreement between you and:

The terms 'us', 'we', 'the company' and/or 'Hide'/ 'Hide date&spot' refer to Global Match.

You and Hide together may be referred to as the 'Parties' or individually as a 'Party'. By accessing or using our Services through the Hide mobile application ('App') or any other platforms or services offered by Hide (together, the 'Service' or our 'Services'), you agree to be bound by this Agreement. This Agreement applies to everyone accessing or using our Services, regardless of registration or subscription status.

Your access to and use of our Services is also governed by the Privacy Policy, Cookie Policy, and any terms disclosed to and accepted by you when purchasing additional features, products, or services from Hide ("Additional Purchase Terms"), which are incorporated into this Agreement by reference. If you do not wish to be bound by this Agreement, do not access or use the Services.

In accordance with applicable law, we reserve the right to amend, supplement, or modify the Terms at any time. Notice of material changes will be posted on this page with the updated effective date. In certain circumstances, we may notify you of changes to the Terms by email or other means; however, you are responsible for regularly reviewing this page for any changes. Your continued access to or use of our Services constitutes your ongoing acceptance of any changes, and, as a result, you will be legally bound by the updated Terms. If you do not agree with the changes to the Terms, you must immediately cease accessing or using our Services. Additionally, we reserve the right to modify the availability of features in our subscription plans.

2. USER OBLIGATIONS AND CONDITIONS FOR CREATING AN ACCOUNT

You are not permitted to create an account or use the Services if any of the following are untrue, and by using our Services, you represent and warrant that:

You are an individual (i.e. not a legal entity, partnership or other commercial organization) aged 18 or over;
You meet the legal requirements to enter into a legally binding agreement with Hide;
The law does not prohibit you from using our Services.
You have not committed, been convicted of, or pleaded guilty to a criminal offence or an offence with a conviction (or an offence of similar severity), a sexual offence, or any offence involving violence or the threat of violence, except where you have received a pardon for a non-violent offence and we have determined that you do not pose a threat to other users of our Services;
You are not required to register as a sex offender in any state, federal, or local sex offender registry;
You do not have more than one account on our Services;
We or our affiliates have not previously removed you from our Services or the services of our affiliates, unless you have our express written permission to create a new account.

If at any time you cease to meet these requirements, all permissions to access our Services or systems will be automatically revoked, and you must immediately delete your account, and we reserve the right to remove your access to our Services without notice.

You agree to:

Comply with these Terms and periodically check this page to stay informed of any changes;
Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws and regulatory requirements;
Use the latest version of the App;
Review and follow the Community Guidelines, which are updated from time to time;
Take reasonable steps to protect the security of your login information.

You agree not to do the following:

Provide false information about your identity, age, or affiliation with any individual or legal entity;
Use the Services in a way that harms the Services or interferes with others' use of them;
Use our Services in a way that interferes with, disrupts, or negatively affects the platform, servers, or networks of our Services;
Use our Services for any harmful, illegal, or malicious purposes, including, but not limited to, using any Virtual Items for money laundering or other financial crimes;
Stalk, intimidate, harass, threaten, assault, defame, harm, or otherwise abuse or cause psychological harm.
Posting or sharing prohibited content (see below);
Requesting passwords for any purpose or personal data for commercial or illegal purposes from other users or distributing personal data of others without their consent;
Soliciting money or other valuable items from another user, whether as a gift, loan, or form of compensation;
Using another user's account;
Using our Services in connection with fraud, pyramid schemes, or other similar practices;
Using our Services in connection with funding any political campaign or attempting to influence any elections, except for sharing your personal political views;
Violating the license terms granted to you by Hide (see section 6 below);
Disclosing private or official information that you are not authorized to disclose;
Copy, modify, transmit, distribute or create derivative works from any Subscriber Content or Our Content, or any copyright-protected materials, images, trademarks, trade names, service marks, or other intellectual property, content or information owned and available through our Services, without the prior written consent of Hide;
Attempt to present any of your statements as assertions approved by Hide;
Use any robots, crawlers, search/extraction applications on the site, proxies or other manual or automatic devices, or use methods or processes to access, extract, index, 'data mine,' or otherwise reproduce or circumvent the navigation structure or presentation of our Services or their content;
Upload viruses or other malicious code or otherwise compromise the security of our Services;
Falsifying headlines or otherwise manipulating identifiers to conceal the origin of any information transmitted to or through our Services;
"Posting" or "mirroring" any part of our Services without prior written permission from Hide;
Using meta-tags, code, or other devices containing any reference to Hide or the platform (or any Hide trademark, trade name, service mark, logo or slogan) to direct anyone to any other site for any purpose;
Modifying, adapting, sublicensing, translating, selling, reconstructing, decrypting, decompiling, or otherwise disassembling any part of the Service or encouraging others to engage in such actions;
Use or develop any third-party applications that interact with our Services or Content or Subscriber information without our written consent, including but not limited to artificial intelligence or machine learning systems;
Use the Hide application programming interface, access it, or publish it without our written consent;
Explore, scan, or test the vulnerability of our Service, any system, or network;
Encourage, promote, or consent to participating in any activity that violates these Terms;
Create a new account after we have suspended or terminated your account, unless you have received our direct permission.
To report subscriber behavior or published content that is false, misleading, or otherwise clearly unfounded, or to abuse any messaging or appeal system available in Hide. The license granted to you under these Terms, and any permission to access the Services, will be automatically revoked if you engage in any of the above actions.

Prohibited content - Hide prohibits uploading or sharing content that:

May reasonably be considered as harassment, persecution, violence or causing psychological suffering to another person;
Is obscene, pornographic, violent or contains nudity;
Is offensive, threatening, discriminatory or promotes racism, sexism, hatred or intolerance;
Encourages or promotes any illegal activity, including, without limitation, terrorism, incitement to racial hatred, the provision of which is itself a criminal offence;
Encourages or promotes any activity that may cause harm to the user or another person, including, but not limited to, the promotion of self-harm, eating disorders, dangerous challenges, violent extremism.
Is defamatory, libelous or false;
Relates to commercial activities (including, without limitation, sales, contests, promotions and advertising, offering services, sex work, relationships with wealthy older sponsor lovers or sugar daddies/mommies, links to other websites or premium-rate phone numbers);
Involves or facilitates the transmission of spam;
Contains any spyware, adware, viruses, corrupted files, 'network worms' or other malicious code intended to interrupt, damage or limit the functionality or disrupt the operation of any software, hardware, telecommunications, networks, servers or other equipment, trojans or any other material intended to harm, interfere with, unlawfully intercept or expropriate any data or personal information, whether from Hide or other sources;
Violates the rights of third parties (including, without limitation, intellectual property rights and privacy rights);
Was not written by you, unless explicitly authorized by Hide;
Includes an image or likeness of another person without their consent (or, in the case of a minor, without the consent of their parents or guardians);
Includes an image or likeness of an unaccompanied minor or a minor who is not fully clothed, or otherwise depicts or implies a minor engaged in sexual activity;
Is inconsistent with the intended use of the Services;
May harm the reputation of Hide or its affiliates, that is, uploading or sharing content on the Hide platform that is defamatory to Hide or its affiliates or promotes improper use of the Service or any service provided by Hide affiliates.

Uploading or distributing content that violates these Terms ("Prohibited Content") may result in the immediate suspension or termination of your account.

3. CONTENT

During your use of our Services, you will have access to:

content that you upload or provide while using our Services, even if it is offered by our Services ("Your Content");
content that other users upload or provide while using our Services ("Subscriber Content");
content that Hide provides on and through our Services ("Our Content").

In this agreement, "content" includes, without limitation, all text, images, video, audio and other materials on our Services, including information in user profiles and in direct messages between users.

You are fully responsible for Your Content and therefore agree to indemnify, defend and hold us harmless from any claims related to Your Content.

You represent and warrant to us that the information you provide to us or any other user is accurate, including any information from third-party sources (if applicable), and that you will update your account information as necessary to ensure its accuracy.

The content posted on your individual profile must conform to the intended use of our Services. You may not upload prohibited content, and your content must comply with the Community Guidelines. You may not display any personal contact, banking, or payment information relating to yourself or any other person (such as names, home addresses or postal codes, phone numbers, email addresses, URLs, credit/debit card usernames, peer-to-peer payment system details, or other banking information). If you choose to disclose any personal information about yourself to other users, you do so at your own risk. We strongly recommend that you exercise caution when disclosing any personal information online.

You also acknowledge, represent and warrant that:

you own or have obtained all necessary licenses, rights, consents and permissions to use the content you publish, and you authorize Hide to use all intellectual property and any other proprietary rights in any and all content to ensure its inclusion and use in accordance with these Terms;
you have obtained the written consent, release and/or authorization of each identifiable individual or entity within the published content to use personal data (including, but not limited to, the name or likeness) of each such identifiable individual to ensure inclusion and use of the content in accordance with these Terms of Use.
you understand that when using Hide you will be exposed to content from various sources and that we are not responsible for the accuracy, usefulness, safety or intellectual property rights of such content or in relation to such content.

You also understand and acknowledge that you may encounter content which is inaccurate, offensive, obscene or controversial. Your individual profile will be visible to other people worldwide, so make sure you are comfortable sharing your Content before posting it. You acknowledge and agree that your Content may be viewed by other users and, notwithstanding these Terms, other users may transmit your Content to third parties. By uploading your Content, you represent and warrant to us that you have all necessary rights and licenses to do so, and automatically grant us a license to use your Content in accordance with Section 7 below.

We may provide tools and features to enhance individual self-expression through your content and the content of your followers, and we are continually developing new technologies to improve our Services. Certain tools or features may allow you to create or enhance content based on your content. It is still your content, and you are responsible for it and its accuracy, as well as for its use in our Services and any decisions, actions, or failures to act based on your content. Be careful in choosing and sharing your Content.

You understand and agree that we may monitor or review your content, and we have the right to remove, delete, edit, restrict, block, or prevent access to any of your content at any time at our discretion. In addition, you understand and agree that we are not required to display or review your content.

USER CONTENT

Other users will also share content on our Services. Subscriber Content belongs to the user who posted it, is stored on our servers and is displayed at the direction of that user.

You should always carefully review and independently verify Subscriber Content for accuracy. Other users may use tools to create or enhance content based on the Subscriber Content provided. Subscriber Content may contain biased, inaccurate, harmful, offensive or misleading information. Other users are responsible for their Subscriber Content, as well as for all decisions made, actions taken and failures to act based on their use of Subscriber Content.

You have no rights to Subscriber Content, and unless Hide expressly permits you to use Subscriber Content, you may use it only to the extent that your use is consistent with the purpose of our Services - to enable you to communicate and meet with each other. You may not copy Subscriber Content or use Subscriber Content for commercial purposes, spam, harassment, or illegal threats. We reserve the right to terminate your account if you misuse Subscriber Content.

OUR CONTENT

Any other text, content, graphics, user interfaces, trademarks, logos, sounds, illustrations, images and other intellectual property presented in our Services are owned, controlled or licensed by us and protected by copyright, trademark and other intellectual property rights. All rights, title and interest in Our Content remain with us at all times. We grant you a limited license to access and use Our Content in accordance with section 6 below, and reserve all other rights.

UNACCEPTABLE CONTENT AND UNLAWFUL BEHAVIOR

We strive to maintain a positive and respectful community, and we do not tolerate any unacceptable content or unlawful behavior, either within the Services or outside them (including, but not limited to, services operated by our affiliates). We encourage you to report any unacceptable Subscriber Content or unlawful actions by other users. You can report a user directly from their profile. You can also contact customer support.

You understand and agree that we are not permitted to share information regarding your account with you if doing so could compromise the security or privacy of other users.

4. PHOTO VERIFICATION

The photo verification feature is mandatory and is solely intended to allow Users to confirm that the photo they previously submitted for verification reflects their actual appearance as captured by the camera.

To verify your appearance, we will analyses the photo, use facial recognition technology to compare your face with the photo, and confirm a match.

Please note that the photo verification feature is designed to confirm the match between the User's real face and the photo, but it does not verify the User's identity and may not always accurately reflect the User's true likeness.

Users should be aware that this feature may not always be entirely accurate, which could result in the verification being rejected or the match being confirmed even if the photo does not fully reflect the User's actual likeness.

Participation in the photo verification process does not entail any formal verification or legal consequences. We do not obtain any personal characteristics about you through the photo verification feature. If Hide does not find a match of photographs following the photo verification, the User will be prompted to replace the photographs. If a User fails photo verification for identity confirmation, access to Hide services for that User will be restricted.

5. CONFIDENTIALITY

To find out how Hide and its affiliates collect, use and share your personal data, please refer to our Privacy Policy. By using our Services, you agree that we may use your personal data in accordance with our Privacy Policy.

6. RIGHTS PROVIDED TO YOU BY HIDE

While you comply with these Terms, Hide grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for the purposes set out by Hide and permitted under these Terms and applicable law. This license and any access permission to the Service are automatically terminated if you do not comply with these Terms.

7. RIGHTS YOU GRANT TO HIDE

By creating an account, you grant Hide a worldwide, perpetual, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, incorporate into other works, advertise, distribute, and otherwise make available to the public your Content, including any information you allow us to access from Facebook or other third-party sources (if applicable), in whole or in part, by any means and in any format or media known now or developed in the future. Hide's permission to use your Content is non-exclusive, except for the exclusivity of Hide's rights regarding derivative elements created using the Services. For example, Hide holds an exclusive license to use screenshots of the Services in which your Content.

You agree that Hide may access, store and disclose information about your account, including your Content, if required by law or in good faith belief that such access, storage or disclosure is reasonably necessary to:

comply with legal processes;
enforce these Terms;
respond to claims that any content infringes the rights of third parties;
respond to your customer service requests;
protect the rights, property or personal safety of the Company or any other person, or to investigate, prevent or take action regarding illegal activity, suspected fraud or other wrongdoing.

8. PURCHASES AND AUTOMATIC SUBSCRIPTION RENEWAL

Hide may offer products and services for purchase through iTunes, Google Play, the App Store or other external services authorized by Hide (each an "external service" and any purchases made through it a "purchase through an external service").

Hide may also offer products and services for purchase using a credit card in the App ("In-App Purchases").

If you purchase a subscription, it will automatically renew until you cancel it in accordance with the terms provided to you at the time of purchase, as described below.

If you cancel your subscription, you will retain access to your benefits until the end of the subscription period, after which it will cease.

Since some of our Services can be used without a subscription, cancelling your subscription will not delete your profile from our Services, but it will restrict access to the dating section. If you wish to completely deactivate your account, you must do so as outlined in this section.

Hide operates worldwide, and our prices vary depending on a number of factors. We often offer promotional prices -- these may vary by region, subscription duration, package size, past purchases, account activity, and so on. We also regularly test new features and payment methods.

If you do not cancel your subscription in time, your subscription will be renewed at the full price indicated at the time of purchase, without any additional action on your part, and you authorize us to charge your payment method for this amount. Within the limits permitted by law, we reserve the right, including without prior notice, to limit the available quantity or discontinue the provision of any product, feature, service or other offering; impose conditions on the use of any coupon, discount, offer or other promotion; prohibit any user from performing any actions; and refuse any user access to any product, service or other offering.

When making a purchase through the Service, you may have the option to pay through an External Service, such as using your Apple ID or Google Play account ("Your External Service Account"), and the purchase amount will be charged to your External Service Account in accordance with the terms disclosed to you at the time of purchase and the terms applicable to your External Service Account.

Some External Service providers may charge you sales tax based on your place of residence, which may change from time to time. If your external service purchase includes an auto-renewable subscription, your external service account will be charged periodically for the subscription until you cancel it. After the initial subscription period and any subsequent subscription period, the subscription will automatically renew at the price and for the period agreed upon when you subscribed. If you received a promotional offer with a discount, your price may increase according to the terms of this offer after the initial subscription period and in any subsequent renewal period.

To cancel a subscription: if you do not want your subscription to renew automatically, or if you wish to change or end your subscription, you must log in to your account on the External Service and follow the instructions for managing or cancelling your subscription, even if you have deleted your account with us or removed the App from your device. For example, if you subscribed using your Apple ID, the cancellation will be handled by Apple, not Hide. To cancel a purchase made with your Apple ID, go to Settings within the app and follow the cancellation instructions. You can also contact Apple Support for assistance. Similarly, if you subscribed via Google Play, the cancellation is managed by Google. To cancel a purchase through Google Play, open the Google Play app on your mobile device and go to Settings. You can also request assistance from Google Play.

If you have cancelled your subscription, you may continue to use the cancelled service until the end of the current subscription period. The subscription will not be renewed when your current term expires. If you initiate a refund or otherwise cancel a payment made through your account in the External Service, Hide may immediately suspend your account at its discretion on the basis that you have decided not to subscribe to Hide.

If your refund or other payment refusal has been reversed, please contact customer service. Hide will hold all funds charged to your account in the External Service until you cancel the subscription through your account in the External Service.

Some users may be entitled to request a refund.

9. PAID MESSAGING SERVICE

In the Hide dating app section, users can send messages to other users for free if both participants in the conversation have marked each other as liked.

A user who has not received a like can pay to send one message to any other user.

The cost of a message depends on the region, type of subscription, and the number of messages in the package.

10. REFUND POLICY

Generally, all purchases are final and non-refundable, and no refund or credit is given for partially used periods, except where required by the laws applicable in your jurisdiction.

For subscribers residing in the EU, EEA, the United Kingdom, and Switzerland: Under local law, you are entitled to a full refund within 14 days of the start of the subscription. Please note that the 14-day period begins from the start of the subscription.

For subscribers residing in Germany: You may cancel the subscription after it has renewed by giving one month's notice. Your right to terminate the agreement for a valid reason remains unaffected.

If any of the above applies to you and you signed up using your Apple ID, your refund requests will be handled by Apple, not Hide. To request a refund, contact your external service directly; for example, using your Apple device, go to Settings > iTunes & App Stores > [tap your Apple ID] > View Apple ID > Purchase History. Find the transaction and select "Report a Problem." You can also request a refund through Apple Support.

For any other purchase, please contact Hide Customer Support, providing your order number (see your email confirmation) by mail or delivering a signed and dated notice stating that you, the purchaser, are cancelling this Agreement, or words to similar effect. In the notice, in addition to the order number, please provide the email address or phone number registered in the account. This notice should be sent to: Makenzijeva 37, 2nd Floor, Belgrade, Serbia, 11000.

11. ACCOUNT TERMINATION

You can delete your account at any time by logging into the App, going to "Settings", clicking "Delete Account", and following the instructions to complete the deletion process. However, you must cancel/manage any purchases of external services through your external service account (e.g., iTunes, Google Play) to avoid being charged further.

Hide reserves the right to conduct an investigation and, if necessary, suspend or terminate your account without a refund if Hide believes that you have violated these Terms, misused our Services, or behaved in a manner that Hide deems inappropriate or unlawful, on or off our Services. We reserve the right to use any personal, technological, legal, or other means available to enforce the Terms at any time without liability and without the obligation to notify you in advance, including, but not limited to, preventing your access to the Services. If your account is terminated by you or Hide for any reason, these Terms will continue to apply and remain in force between you and Hide, and you will not be entitled to a refund for any purchases made. Your information will be retained and deleted in accordance with our Privacy Policy.

12. LACK OF CHECKS FOR CRIMINAL RECORDS OR IDENTITY VERIFICATION

Hide makes no representations or warranties regarding the behavior, character, health, physical condition, intentions, legality or truthfulness of users. Hide reserves the right to conduct -- and you agree that Hide may conduct - any criminal background check or other checks (such as a search of the sex offender registry) at any time using publicly available records, and you agree that any information you provide may be used for these purposes. If the company decides to conduct a check through a consumer reporting agency, you consent to the company obtaining and using it Information about you to determine your compliance with these conditions.

You bear sole responsibility for interactions with other users. We cannot guarantee and do not guarantee your safety and do not replace following safety advice and other reasonable precautions. Always exercise caution and take appropriate precautions when interacting or meeting new people. Messages received through the service, including automatic notifications sent by Hide, may result from users misusing the service for improper purposes, including fraud, abuse, harassment, or other similar inappropriate behavior. While Hide seeks to encourage respectful treatment of users, it is not responsible for the behavior of any user within or outside the Service. You agree to exercise caution when interacting with other users, especially if you choose to communicate outside of the Services or meet in person.

13. DISCLAIMER

Hide provides our services on an "as is" and "as available" basis and, to the extent permitted by applicable law, makes no warranties, express, implied, statutory or otherwise, regarding our services (including all content contained therein), including, without limitation, any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement. Hide does not represent or warrant that our services will be uninterrupted, secure or error-free, that any defects or errors in our services will be detected or corrected, or that any content or information you obtain through or from our services will be accurate, complete, current or suitable for your purposes.

Furthermore, Hide does not make any guarantees regarding the number of active users at any given time; the ability or willingness of users to communicate with you or meet you, as well as the ultimate compatibility with users you meet through our services, or regarding the behavior of these users. Hide is not responsible for any content that you or another user or a third party post, send, receive or perform through our services, and Hide is not responsible for the identity, intentions, legality or accuracy of any users you may interact with through Hide. You access materials uploaded or otherwise obtained via the services at your own risk. Hide is not responsible for any damage to your computer equipment, software, or other equipment or technology, including, but not limited to, damage from security breaches or any virus, software errors, interference, hacking, fraud, mistakes, omissions, interruptions, defects, delays in operation or transmission, computer line or network failures, or any other technical or other malfunction or defect. Hide is also not responsible for the quality of services provided by third-party organizations, including establishments and stores recommended by Hide.

14. DIGITAL MILLENNIUM COPYRIGHT ACT

Hide has adopted the following policy regarding copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"). If you believe that any Participant Content or Our Content infringes your intellectual property rights, please submit a notice of such infringement ("DMCA Takedown Notice"), including the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive rights that are allegedly infringed;
Identification of the copyrighted work that is claimed to have been infringed, or if a single notification covers multiple copyrighted works located on one site, a representative list of such works;
Identification of the material that is claimed to infringe copyright or to be the subject of illegal activity and that should be removed or access to which should be blocked, as well as information sufficient for the service provider to locate the material;
Information sufficient to allow the service provider to contact you, such as an address, phone number and, if available, an email address;
A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that you accept responsibility for the provision of any knowingly false information and that the information in the notice is accurate, and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Hide undertakes to suspend accounts of repeat infringers.

15. ADVERTISING AND THIRD-PARTY CONTENT

You may see advertisements and promotional content from third parties in our Services. Hide does not endorse and is not responsible for your interactions with such products or services. The Services may contain advertisements and promotions offered by third parties, as well as links to other websites or resources. Hide does not guarantee that you will always be entitled to view such advertisements, or that any such advertising will be available. Hide may also provide non-commercial links or links to third parties in its content. Hide is not responsible for the availability (or lack of availability) of any external websites or resources or their content. Furthermore, Hide is not responsible for any products or services that may be offered on third-party websites or resources. If you choose to interact with third parties through our Services, your relationship with them is governed by the terms of those third parties. Hide is not responsible for such conditions or actions of third parties.

16. LIMITATION OF LIABILITY

In accordance with applicable law, Hide, its affiliates, employees, licensors or service providers shall not be liable for any indirect, consequential, incidental, special, punitive or severe damages, including but not limited to direct or indirect loss of profit, or any loss of data, use, reputation or other intangible losses, arising from:

your access to or use of, or inability to access or use, the service;
actions or content of other subscribers or third parties, committed or related to the service;
unauthorized access, use or alteration of your content, even if Hide was aware of the possibility of such damages.

To the maximum extent permitted by applicable law, under no circumstances shall Hide's total liability to you for all claims related to the services exceed the greater of: (a) $100 USD or (b) the amount paid by you to Hide for the services, if any, during the twenty-four (24) months immediately preceding the date you first filed a claim, arbitration or any other legal proceeding against Hide, whether in law, equity or in any court.

The limitation of liability, as set out in the immediately preceding clause, applies regardless of the basis on which liability arises (whether in default, contract, tort, or otherwise), without regard to the type of infringement of rights, privileges or obligations, and in respect of all events, services and this agreement. In some jurisdictions, the limitation of certain damages is not permitted, so some or all limitations in this section may not apply to you.

17. APPLICABLE LAW

This agreement is governed by and construed in accordance with the substantive law of Serbia, without applying any conflict of law rules and to the extent that applicable consumer protection laws of the jurisdiction in which the User resides are not excluded or restricted.

The primary purpose of this Agreement is to provide services and license access to intellectual property, not the "sale of goods". This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

18. SECTION "DISPUTE RESOLUTION" INFORMAL DISPUTE RESOLUTION PROCESS

If for any reason you are not satisfied with our Services, please first contact Hide Customer Support so we can try to resolve your issues without third-party involvement. If you choose to file a dispute, claim, or disagreement against Hide, these terms shall apply.

Hide values its relationship with you and appreciates the mutual benefits of informal dispute resolution. A "Dispute" is any dispute, claim or disagreement between you and Hide arising out of or in any way related to this Agreement (including any alleged breach of this Agreement), the Service or our relationship with you. The term "Dispute" as used in this Agreement shall be interpreted broadly and includes claims arising before entering into this or any previous Agreement, as well as claims arising during the term of this Agreement or after its termination (unless this Agreement is replaced by a subsequent Agreement entered into between you and Hide). If you have a dispute with Hide ("Your Dispute"), then before formally taking your dispute to court, you agree to first send a detailed notice ("Notice") to Hide's legal address:

You and Hide agree to then engage in good faith negotiations in an attempt to resolve the dispute. As part of these good faith negotiations, Hide may request to arrange a conference call with You to discuss Your dispute, and You agree to participate in person, along with Your lawyer if You are represented by one. Similarly, You may request to arrange a conference call to discuss Hide's dispute with You, and Hide will agree to the participation of one representative. (For the avoidance of doubt, the termination of Your Hide account as mentioned in Section 4 above is not a Hide dispute with You.) This informal process is intended to lead to the resolution of the dispute. However, if the dispute is not resolved within 60 days after receipt of a fully completed Notice, and the parties do not mutually agree to extend this informal dispute resolution period, either You or Hide may initiate court proceedings.

19. JURISDICTION

To the extent permitted by applicable law, all disputes arising in connection with the Agreement shall be subject to the exclusive jurisdiction of the ordinary courts at our legal location.

20. COPYRIGHT INFRINGEMENT NOTICE

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement in accordance with applicable law. If you believe that any materials available in the application infringe your copyright, you may request the removal of such materials (or access to them) from the application by sending a written notice to our legal address:

In accordance with the Digital Millennium Copyright Act (17 USC § 512) ("DMCA"), a written notice ("DMCA Notice") must substantially include the following:

Your physical or electronic signature.
Identification of the copyrighted work that you believe has been infringed, or, if the claim involves multiple works listed in the appendix, a representative list of such works.
Identification of the material you believe infringes the copyright with sufficient accuracy for us to locate it.
Relevant contact information so we can reach you (including your name, mailing address, phone number, and, if available, email address).
A statement that you genuinely believe that the use of the copyrighted material is not authorized by the copyright owner, their agent, or the law.
A statement that the information contained in the written notice is accurate.
A statement (under penalty of perjury) that you are authorized to act on behalf of the copyright owner.

Please be aware that if you knowingly provide false information about material or activity on the Website infringing your copyright, you may be held liable for damages (including costs and attorney fees) under section 512(f) of the DMCA. Our policy is to, where appropriate, disable and/or terminate user accounts that have repeatedly infringed rights.

22. INDEMNIFICATION BY YOU

You agree, to the extent permitted by applicable law, to indemnify, defend and hold harmless Hide, our affiliates, and their and our respective officers, directors, agents and employees from any and all claims, demands, liabilities, damages, losses, costs, obligations and expenses, including legal fees, arising out of or related to your access to or use of our Services, your Content, your conduct in relation to other users or your breach of this Agreement. In some jurisdictions, indemnification provisions are not permitted, so some or all of the provisions of this section may not apply to you.

23. ACCEPTANCE OF TERMS

By using our Services, whether via a mobile device, mobile application or computer, you agree to these Terms, which we may modify from time to time, our Privacy Policy, Cookie Policy, and any Additional Terms when making a purchase. If you do not accept and agree to comply with all the terms of this Agreement, you are not authorized to use our Services.

All pronouns and any of their variations are to be considered as referring to masculine, feminine, neutral gender, singular or plural, depending on the context of the referenced subjects or persons.

24. ENTIRE AGREEMENT

This Agreement supersedes all prior agreements or statements.

These Terms, together with the Privacy Policy, Cookie Policy, and any Additional Purchase Terms constitute the entire agreement between you and Hide regarding your use of our Services. If any provision of these Terms is found to be invalid, illegal or otherwise unenforceable, the remaining provisions shall remain in full force and effect. The Company's failure or delay in exercising any right or provision of these Terms shall not constitute a waiver of such right or provision. You agree that your Hide account is non-transferable and all your rights to the account and its content will cease upon your death unless otherwise required by law. Any rights and licenses granted under this document may not be transferred or assigned by you, but may be assigned by us without restriction. This Agreement does not create a joint venture, agency, partnership, employment, trust or any other relationship. You are not authorized to make any statements or assume any obligations on behalf of Hide.
